Who these terms are between

They are between you and Josh Salway, the independent developer of Chinwag. There is no company, no support desk and no account system. If something goes wrong you are emailing a person.

By downloading the app or using this website you accept these terms. If you do not accept them, do not use the app.

What Chinwag is, and what it is not

Chinwag deals question cards to a group who pass a phone around. That is the whole product. It is entertainment. It is not therapy, counselling, relationship advice or a diagnostic tool of any kind, and nothing in the app should be treated as professional advice.

The guides on this website describe how to run a good conversation. They are written from published research where research exists, and every study they cite is named and linked so you can check it yourself. They are still just guides.

The house rule

One rule is built into the app and it is part of these terms: anyone can pass on any card, at any time, without giving a reason. Nothing in Chinwag requires a player to answer, to drink, or to reveal anything they would rather not.

Chinwag is a game people play with each other, so the atmosphere is yours to set. Do not use it to pressure, embarrass or corner someone. If a card is not right for your room, skip it. That is what the button is for.

Age

Chinwag is rated for adults and four decks are marked 18+. Those decks stay hidden unless Apple's private age-range check confirms an adult, and we never receive a date of birth. If the check says under 18, or cannot complete, Family Mode starts automatically and only the mixed-age decks are dealt.

You must be old enough to hold an Apple Account and to make a purchase in your country. If you are under that age, ask whoever manages the Apple Account before subscribing.

What is free and what is paid

The New Friends deck is free forever, with no trial and no time limit, and so is Your Cards, where you write your own prompts. In the two-player Duo mode, the Funny and Everyday mood is free.

Chinwag Plus unlocks every other deck and every other Duo mood. It is sold monthly or yearly. There is no weekly plan and no lifetime unlock.

Subscriptions, billing and cancelling

Chinwag Plus is an auto-renewing subscription. The current price is shown in the app before you buy, in your own currency, because Apple sets the local price for every country it sells in.

• Payment is charged to your Apple Account at confirmation of purchase.
• It renews automatically unless you turn off auto-renew at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours before the period ends.
• Manage or cancel any time in your Apple Account subscription settings. There is a link to that screen in the app's own settings.
• Cancelling stops the next renewal. It does not end the period you have already paid for, and you keep Plus until that period runs out.
• If a free trial is offered and you subscribe before it ends, the unused part of the trial is forfeited, which is Apple's rule and applies across the App Store.

Refunds are handled by Apple, not by us. We never see your payment details and we cannot issue, refuse or reverse a charge. Refund requests go through Apple's own process at reportaproblem.apple.com. If Apple refunds a subscription, access to Plus ends.

Restore Purchases is available on the purchase screen if you change phone or reinstall the app. Because there are no accounts, restoring works through the Apple Account that made the original purchase.

Prices and changes to the app

Prices can change. If the price of a renewal changes, Apple asks you to agree before charging the new amount, and if you do not agree the subscription simply does not renew.

The catalogue grows. Decks and questions are added, and occasionally a question is reworded or removed because it does not meet our editorial standard. A subscription buys access to the catalogue as it exists while you are subscribed, not a permanent claim on any particular card.

Your own cards

Anything you write in Your Cards is stored on your device and nowhere else. It is never uploaded, never read by us and never shared between players' phones. It stays yours. It also means we cannot recover it if you delete the app, and there is no backup we can restore from.

You are responsible for what you write, particularly if you hand the phone to somebody else.

What you may not do

• Copy, republish or resell the question catalogue, in whole or in substantial part. The questions are original work and took a long time to write.
• Reverse engineer the app except where the law expressly allows it.
• Use the app or the catalogue to harass, humiliate or target a specific person.

You are welcome to quote a handful of questions in a review, a video or a post. That is not what this clause is about.

Intellectual property

The app, the website, the artwork and the question catalogue belong to Josh Salway. Buying a subscription buys access, not ownership.

Availability

Chinwag runs on your phone and deals rounds offline, so it does not depend on us keeping a server up. Purchases and restores do need a network connection, and paid decks keep working offline for a grace period once a subscription has been confirmed.

We do not promise the app will be free of every bug, or available forever. If it is ever withdrawn, active subscriptions would be dealt with through Apple.

Liability, and the part that cannot be excluded

Chinwag is provided as it is. To the extent the law allows, we are not liable for indirect or consequential loss arising from using it.

Nothing in these terms excludes rights you have under the Australian Consumer Law, or under equivalent consumer law where you live. Those rights cannot be contracted away, and this document does not try to.

Changes to these terms

If these terms change, the effective date at the top changes with them, and a material change will be noted in the app's release notes rather than made quietly.

Governing law

These terms are governed by the law of Queensland, Australia. That does not remove your right to bring a claim under the consumer law of the country you live in.
